Resolved Question: Can my manager do these things? (Restaurant server)?

I live in Butte, MT (unfortunately, but thanks to our military and i support my husband where ever we go). I work at a privately owned Steakhouse. At the end of the night when servers do their "check out" there is a portion of money based on our food sales that must go to the cooks. If you have a busy night and have big table and whatever, your "tip-out" to the cooks can be kinda big. I think for every $100 in food sales you tip out $3. I've NEVER heard of having to tip out your cooks. Bussers, hosts, bartenders yeah, I did that at Outback when I worked there years ago. But cooks always got paid the highest! Our cooks get $8.00/hr...and servers get $7.65/hr (min wage). The cooks wait until the very end of the night until the last server has done their check out and put money in the pile for the cooks.... then as a general rule you give half of what you gave to the cooks to the bussers. So if your little print out said that you had to tip out $24 to the cooks, if you feel the busseres did good, you would put $12 in the bussers pile. Tipping out the busser b/c they did a fast job of cleaning your tables is cool, but REQUIRING you to tip out the cooks...?? Is that even legal? Can my manager make me do that...? People who have served at this place for 12+ years just do it. Even if your cook did terrible, took forever and gave you bad steaks to serve, yes you STILL have to give them the money on your little print out at the end of your shift as a tip out. Also, if your cash drawer is short ($.05-$6) at the end of the night can your manager make you pay it...?? Also, if the owner made me attend a "alcohol class" (3 hours, took a test and got a certificate) at work during my normal time off and I did not get paid for it....was I supposed to get paid for it?? If I did not attend this class at work I would have had to pay $50 and done it online. The class was at my place of employment and many other servers from other places came to join. Our boss said he did not have to pay us because "the State of Montana requires it" and I'm trying to figure out if that is true or not...? Also, if the scheduale the manager writes for you says "5pm-close" and you show up and clock in at 4:55pm can the manager legally change you rclock in time..? She says yes because your schedualed time is 5pm, not 4:55pm. I mean, even if I get there and clock in at 4:59pm she still changes it to 5pm. She doesnt change the clock out times, but every night she goes through and changes every persons clock in time. The place I work at is wild and for being a fine dining kind of steakhouse, it is I guess. The servers never leave because they make such good money in tips. Like I said, some have been there for 12+ years and the last server hired was 4 years ago. The manager has been there for 22 years. The people who work ther get away with anything, come to work hungover, our cooks are sometimes coming down from being high, and the men who are servers who have been here for years have a mouth to kill. I messed up cashing out a ticket and was called a dumb fat bitch and was told to get my sh!t straight. That was also said right in front of my manager and all she said was, "ok enough with all of this!" ANYWHERE else I've worked, he would have been fired right then. Our salad kitchen is also made up of nothing but pre-releasers who clean up messes on the floor with their hands then go to continue making salads without washing!! They scratch their heads and rub their eyes, they grab ahand full of lettuce and prepare it!! I need help people...what do I do..? where to start...? THANK YOU WOW. Okay thank you. I hadn't thought about being disciplined for clocking in early and not being able to "follow the rules" of being able to clock in at the normal time. I hate to be late but gosh, being early and having my time changed to the correct time is better then being late because I'm getting fed up! When my cash drawer comes up over at the end of the night, usually I leave the money in and let the manager figure it out because they go in and audit all the drawers at the end of the night. I rather leave in $2 that I'm over then have my manager text me at midnight when she is doing the drawers saying hey you did your check out wrong and you actually owe $2. I've been over $20, over $10 over little stuff too. But I've also been short $20 or so and $5 and a few cents almost every night. I used to work at a bank so I'm good with my money and very protective. When I'm short I always put it in. When I'm over I just leave it. Things... Read More »
